TERMS & CONDITIONS OF PARTICIPATION
1.Micro Star International reserves the right to amend, revise, delete, edit, add to and/or withdraw these Terms and Conditions and the prizes to be awarded at any time without notice, in which event, MSI shall have no liability whatsoever to any person and/or entity as a result thereof.
2.Each winner will obtain a free U135 pink netbook. There will be a total of 2 winners. 
3.MSI shall be entitled to forfeit the prize, require its return, and dispose of the same in any manner it deems fit. 
4.All winners shall be responsible for any additional costs, insurance, duties, taxes, licenses, permits, approvals and/or other incidental expenses which may be incurred as a result of and/or related to the winner's acceptance of the said prize(s). 
5.The Contest is open to all legal residents, aged 21 and above, of the following countries: UK, Germany, France, Poland, Netherland, Czech Republic, Serbia, Spain, Portugal, Italy, Canada, Japan, Korea, Malaysia, Singapore, India, Thailand, Taiwan, Australia and the United States. Except for Japan, the legal age for this Contest is 20 years old and above.
6.Employees of MSI, its respective subsidiaries, divisions, affiliates, authorized dealers/distributors, agents and their immediate families are not eligible to enter the Contest. MSI reserves the right to disqualify any such person from receipt of any prize and/or require the return of any such prizes awarded. In such event, MSI reserves the right to redraw a new winner for the prize and/or dispose of the prize in any manner it deems fit, at its sole discretion.
7.The prize winners will be selected by MSI on July 12, 2010. All winners will be notified by electronic mail in accordance with the particulars provided by the participant during registration. MSI shall not be responsible for any inaccuracy in any information, and/or personal or contact particulars provided by the participant, and shall not be liable for any such errors or any loss suffered by the participant as a result.
8.Prizes are non-transferable and not exchangeable for cash, unless otherwise specified herein. There shall be no substitution of prizes except as determined solely by MSI in its sole discretion. In the event MSI is unable to provide the stated prize, MSI reserves the right to award a prize of equal or greater value. All prizes are subject to the terms and conditions of the supplier of the prizes. 
9.Each participant agrees to indemnify MSI from any third party claims arising from or related to that participant's participation in the Contest. MSI ,and its respective subsidiaries, divisions, affiliates, authorized dealers/distributors, agents, officers and/or employees shall not be liable for any claims, damages, injuries and/or loss (including but not limited to any indirect and/or consequential damage or loss) , tax liabilities suffered by any of the participants arising from or relating to, in whole or in part, this Contest, including entry and participation in this Contest and acceptance, possession, use or misuse of the prizes.
10.MSI, its respective subsidiaries, divisions, affiliates, authorized dealers/distributors, agents, officers and/or employees shall not be liable for any late, misdirected or unavailable network, server or other connections or technical failures. With regard to entries submitted online, in the event of any corruption, disruption and/or other failure of the administration and/or security of the server as a result of any virus, bug or other cause beyond MSI's control, MSI reserves the right to cancel and/or suspend the Contest in respect of the same. 
11.Entries submitted to the Contest should not include any content whatsoever which would reasonably be understood to be defamatory, threatening, distasteful, racist, unlawful or otherwise objectionable.
12.By submitting the entry to MSI in relation to the Contest participants agree to and thereby waive any and all moral rights that exist in their video to the Contest and any derivate works made there from. 
13.By submitting the entries to MSI in relation to the Contest each participant represents, warrants and undertakes to MSI that the entry (i) is his/her own original work and that he/she has the sole right to submit it to the Contest (ii) does not violate in any way rights of third parties including copyright and other intellectual property rights and (iii) does not violate any applicable laws.  Participants in this Contest are liable for any copyright infringements caused by their videos.
14.In the event that any participant breaches any of his/her representations, warranties or undertakings contained herein MSI shall be entitled to and may seek indemnification from the participant for recovery of all legal fees, damages, claims and other expenses that may be incurred by MSI or its affiliated entities as a result of the aforementioned breach. 
15.These Terms and Conditions are to be construed, governed and interpreted in accordance with the laws of Taiwan and all parties agree to submit to the exclusive jurisdiction of the courts of Taiwan.
